Terms of service
These terms are an agreement between Wheel Limited, trading as Push Visibility ("we", "us"), company number 17163116, registered office 26 Cowper Road, Slough, SL2 1TQ, United Kingdom, and the business that opens a Push Visibility account ("you").
1. Who can use Push Visibility
Push Visibility is for businesses: companies, LLPs and sole traders acting for their business. It is not for consumers. By opening an account, you confirm that you act for a business and that you have authority to accept these terms for it. We check a company's Companies House record, or a sole trader's declaration, and that you own the website you add.
2. The service
- Push Visibility checks your website, writes a monthly Visibility Plan, drafts content, review replies and review invitations, publishes what you approve to the accounts you connect, and reports the results.
- You approve everything published in your name. Drafts are prepared with AI from your business's facts. Nothing is posted, replied to or sent without your approval.
- Where Google hasn't yet given us access to its Business Profile tools, we prepare the action and you (or we, as a manager of your profile, with your permission) complete it on Google by hand.
- We rely on Google, Meta, TikTok and other platforms. They may change or limit their services and rules at any time, and we can't control that. We will tell you if a change affects what we provide.
- We improve the service by comparing approaches. To measure fairly, about 5% of accounts receive our standard approach, rather than the latest one, for a period. They still get the full service.
3. No guarantees about rankings or results
Nobody can guarantee a position on Google, a number of reviews, or any level of traffic or sales, and we don't. We will do the work described in your plan with reasonable skill and care.
4. Your responsibilities
- Give accurate information about your business, and keep your sign-in details secure.
- Check drafts before you approve them. You are responsible for what you approve.
- Only ask us to send review invitations to people you are allowed to email. Invite all your customers, not only the ones you expect to be happy.
- Follow the rules of each platform you connect.
- Don't use Push Visibility for anything unlawful, misleading, discriminatory or harmful, including fake reviews or engagement, or content that infringes anyone's rights.
5. Fees and payment
- Plans are charged monthly in advance at the prices on our pricing page. Wheel Limited is not registered for VAT, so no VAT is charged.
- You pay through Stripe, by Bacs Direct Debit or by card.
- If a payment fails, your service continues for a short time while we try again. It is then paused, and after that your subscription is cancelled.
- We will give you at least 30 days' notice by email of any price change. The new price applies from your next billing date after the notice ends, and you can cancel before then.
- Advertising spend is paid by you directly to the advertising platform.
6. Cancellation
You can cancel at any time in your account. Cancellation takes effect at the end of the month you have paid for. Refunds are covered by our refunds and cancellation policy. We may suspend or close an account that breaks these terms or a platform's rules, or that doesn't pay. Unless the matter is serious or urgent, we will tell you first and give you a chance to put it right.
7. Your content and our service
Your content stays yours. You give us permission to store, adapt and publish it as needed to provide the service to you. Content we draft becomes yours once you approve it. The Push Visibility software, website and brand remain ours. We don't use your content to train AI models unless you opt in separately.
8. Data protection
Our privacy notice explains how we use personal data as a controller. When we handle personal data for you, for example your customers' email addresses for review invitations, or reviews and comments on your accounts, we act as your processor, and these terms apply:
- We process that data only on your documented instructions (your use and settings of the service and these terms), unless the law requires otherwise.
- Everyone who handles it for us is bound by confidentiality.
- We keep it secure with appropriate technical and organisational measures, including encryption and access controls.
- We use the sub-processors named in our privacy notice. We will tell you before adding or replacing one, and you may object.
- We help you answer requests from people exercising their data rights, and help you meet your security, breach and impact-assessment duties.
- We tell you without undue delay after we become aware of a personal data breach affecting your data.
- When your account ends, we delete that data, apart from anything the law requires us to keep.
- We give you the information you reasonably need to show that these duties are met.
9. Facebook and Instagram data (Meta Platform Terms)
When you connect Facebook or Instagram, we use Meta's platform as your technology provider. So that we can meet our duties to Meta:
- You must not use Push Visibility to process any data from Meta's platform in a way that breaks Meta's Platform Terms or Developer Policies, and you agree to comply with them.
- We keep each client's data from Meta's platform separate from other clients' data, and we use it only for that client.
- We may give Meta a list of the clients who use Push Visibility with Meta's platform, when Meta asks for it.
- If we receive a request from a person about their data from Meta's platform that relates to your account, we pass it to you promptly, and you agree to deal with it.
- You confirm that you have the authority, and any consent required, for us to publish content on behalf of you or anyone else named or shown in content you approve.
10. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that the law does not allow to be limited. Otherwise:
- We are not liable for loss of profits, revenue, business or goodwill, or for any indirect loss.
- We are not liable for what platforms do, including changing their services, removing content or suspending accounts.
- Our total liability in any 12 months is limited to the fees you paid us in those 12 months.
11. Changes to these terms
We may update these terms. We will email you at least 30 days before a change that affects you, unless the law or a platform requires a faster change. If you don't agree, you can cancel before the change takes effect.
12. Complaints
If something has gone wrong, email hello@push-visibility.com with "Complaint" in the subject line. We acknowledge a complaint within 5 working days and aim to resolve it within 30 days.
13. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
